H-1B CAP Petition

Before filing an H-1B petition, there are some information you should know. One of these information is the H-1B cap petition. H-1B cap petition is the annual number of workers who can be granted a work permit in the United States. In other words, The H-1B cap is a limit to the amount of foreign workers who can be granted a visa to work in the United States annually under H-1B status.

The United States issues H-1B visas to approximately 80,000 people each year. About 20,000 of this bumber is for applicants who have completed a graduate program in the United States. For example, in 2004, the H-1B Cap dedicates 6,800 of the 65,000 H-1B1 visas for citizens of Chile and Singapore. The legal basis for the H-1B cap is the Immigration Act 1990 .  A person with an H1B visa can live and work in the United States for 3 years. This period can be extended for 3 more years depending on your request and your employer’s application.

In some exceptional cases, it is possible to give an extra 1 year. Thanks to this visa, your employer in America cannot hire you below the minimum wage. In other words, the minimum money you will earn is under the guarantee of this visa. But keep in mind that the minimum wage can differ between states.

What is H-1B Status?

There are several types of visas for non-immigrant workers who want to work in the United States. These visa types may vary according to the profession, education and experience of the people. If you do not have a university degree, you must have a certain work experience in a special profession. You must have a diploma (bachelor, master or doctorate) for the job position you are applying or you must have sufficient previous experience in the job you will work in the USA.
